(3) Legal Basis for Processing Your Data on Our Website

  • The legal basis for processing in the reporting office, where we obtain consent for a specific processing purpose, is Art. 6 para. 1, sentence 1 lit. a GDPR.
  • Since the data collected may include particularly sensitive categories of personal or identity-establishing data pursuant to Art. 9 GDPR, Art. 9 para. 2 lit. a GDPR (explicit consent) also applies.
  • The provision of the website and the associated necessary data processing (e.g., temporary log files) is based on Art. 6 para. 1, sentence 1 lit. f GDPR.

(4) Data Processing When Visiting Our Website

The use of our online reporting form is voluntary. During the processing of the reporting form, an access log is set, provided that your browser allows it, without which an online survey would not function. However, this log is automatically deleted as soon as the session ends, meaning after filling out and submitting the form. If you close the browser window without completing the survey, you will not find any data you entered.

When accessing the carrier’s website, general data and information are stored. These general data and information are saved in the server log files.

I. Log File Data

The following may be recorded:
  • The types and versions of browsers used,
  • The operating system used by the accessing system,
  • The website from which an accessing system reaches our website (so-called referrer),
  • The subpages that are accessed via an accessing system on our website,
  • The date and time of access to the website,
  • An Internet Protocol address (IP address),
  • The Internet service provider of the accessing system, and
  • Other similar data and information that serve to avert dangers in the event of attacks on our information technology systems.
These temporarily stored data also help obtain anonymous statistical insights for evaluating usage, system security, and website stability. Furthermore, the data are processed to prevent unauthorized access to the web server, detect any potential misuse of the website, and ensure the security of information technology systems.

II. Cookies

The reporting centers’ website only uses technically necessary cookies, which are deleted after leaving the website.

III. References to Third-Party Websites

Our website contains references to third-party websites in the form of links. Data are only transmitted to these sites when you click on such a link. This is technically necessary. The transmitted data include, for example, your IP address, the time you clicked the link, the page on which you clicked the link, and details about your internet browser. If you do not want these data to be transmitted, do not click these links.

(5) Processing of Personal Data When Using the Reporting Form

I. Purpose of Data Processing

Our goal is to document and analyze anti-Muslim incidents in NRW. The reports help shed light on the statistical dark field in the area of anti-Muslim racism. MEDAR NRW aims to make anti-Muslim racism visible so that affected individuals can receive better support. The statistics should serve as a basis for developing better measures and strategies against anti-Muslim racism.

We do not collect any data with personal data. If a report contains personal data, it will be anonymized immediately.

The incident description is submitted through an online reporting form. The details about the incident itself, the affected groups, and the triggering circumstances are to be statistically evaluated using social science methods. Based on this information, the frequency and types of discrimination should be made visible statewide, and the nationwide support system against discrimination should be further developed.

II. Personal Data

We have implemented data protection measures to largely exclude the entry or storage of personal data in the reporting form.

Personal data refers to information related to an identified or identifiable natural person; this can include names, addresses, phone numbers, dates of birth, email addresses, as well as license plates or other location- and function-related identifiers of individuals, which—either alone or in combination—can lead to an identifiable description.

III. Data Collection via the Reporting Form

The reporting form primarily consists of closed questions (with predefined answer options). It collects information on the status of individuals affected by incidents, anonymized and limited to the dimensions of "gender identity" and "age cohort." Other predefined answers pertain to questions about the date, time, and location of the incident. Subsequent questions regarding the form of discrimination and any multiple discrimination are also controlled by categorized answer options. Comment fields under the categories "Other" or "namely" are limited to 60 characters per question. The incident description, as a qualitative part of the report, is collected through a free-text field.

Please consider the following requirements when describing an incident: Do not name specific individuals or provide personally identifiable characteristics that could identify individuals (see I. Personal Data). If any personal data is provided, we will anonymize it.

IV. Data Storage

The data you enter is stored directly into a protected database via the form interface. Further processing occurs exclusively within the secured areas of the reporting software (web-based), which are protected by appropriate data security measures.

V. Data Processing and Deletion

The log files and your entries in the reporting form are processed immediately in the following steps:

a. Verification: Algorithm-based review of the report with the objectives of:
  • Identifying a report for its technical accuracy,
  • Excluding fake reports,
  • Detecting artificially/digitally generated inputs,
b. Immediately after verification, an automated separation of the technically unavoidable assignment to an IP address through all website activities and the so-called raw data from the reporting form occurs.

Immediately after these steps, the defined anonymisation anonymisation procedure is carried out on the raw data, which is deleted immediately afterwards.

The results are then made available within the reporting software for evaluation by the personnel strictly separated as "Viewers" (i.e., staff responsible for analysis).

(6) Data Sharing

The transmission of anonymized data to third parties or its publication takes place solely within the scope of the data processing purpose, see Point 5 (I). This includes sharing anonymized data with research institutions and cooperating reporting offices, as well as publications.

(7) Your Data Subject Rights

As described in point 5 paragraph IV, the already data-saving content information in the notification form (raw data) is immediately and automatically immediately and automatically separated from the technically necessary personal data personal data (log files, incl. IP address). This means that the necessary identification of a data subject is effectively excluded and requests from data subjects cannot be assigned. Translated with DeepL.com (free version)
